Fitness International, LLC, which has been in business for more than 40 years and operates in 25 states, released the following statement today in response to the Federal Trade Commission’s (FTC) complaint:

“We are disappointed that the FTC has chosen to pursue this complaint. The allegations are without merit, and the statute the FTC relies upon – the Restore Online Shoppers’ Confidence Act (ROSCA), enacted almost 15 years ago – was designed to address only online retail transactions, does not require any specific method of cancellation, and has never before been applied to the health club industry. We remain confident that we will prevail in court.”
It is crucial to remember that all of our personal training subscriptions and the majority of our memberships are bought in person at our club locations. However, we proactively introduced an online cancellation option for all members, regardless of how they joined up, 18 months before the FTC’s new ‘Click-to-Cancel’ rule was set to go into effect. We voluntarily established the ability for members to cancel online with a few clicks, far in advance of regulatory deadlines. Despite the recent invalidation of the FTC’s “Click-to-Cancel” rule by a federal court of appeals, we have decided to maintain our online cancellation service to give members another easy means to cancel. Additionally, members have always had the choice to cancel in person at any club or by mail, and those who choose to do so are able to do so.
Our organization makes a concerted effort to adhere to all state regulations pertaining to health club membership cancellations and to provide, at the very least, all cancellation options mandated by each state. The business has made numerous improvements to its enrollment and cancelation procedures throughout the years.
